Client charged with OVI, a misdemeanor of the first degree. The charge carries a maximum sentence of 180 days in jail, a $1,075.00 fine, fees, and driver’s license suspension. Upon receipt of the discovery from the State's Prosecutor it appeared that the OVI charge was based upon the defendant's performance on the field sobriety test.
Defense Attorney Zachuary Meranda was able to show the state that the tests were not performed with substantial compliance and, through his negotiations, was able to get the case dismissed for the client. This was a huge win for the defendant, who was able to resume work without having to tell his employers that he was charged with DUI
